Public adjusters in Massachusetts: rules, fees and licensed firms

Licensing and how to check a license
- Anyone who, for pay, solicits or represents a homeowner or business in negotiating or settling a property insurance claim must hold a Massachusetts public insurance adjuster license (attorneys acting in their normal practice are exempt), and acting without one can bring a fine of up to $10,000 or up to 6 months in jail.M.G.L. c. 175, § 162 (definition); M.G.L. c. 175, § 172 (license and penalty) ↗

Your right to cancel
- You can cancel a public adjuster contract with no penalty by delivering written notice (in person, by fax, overnight delivery, or certified/registered mail to the address in the contract) within 3 calendar days of receiving it; after that you can still revoke it at any time, but the adjuster can claim a lien for their agreed percentage on insurance money they obtained, and you remain responsible for reasonable emergency expenses they paid during the 3-day window.M.G.L. c. 175, § 172 ↗
What the contract must include
- The contract must be in writing on a form approved by the Division of Insurance, and the adjuster cannot use a form until it has been on file with the Division for 30 days (unless approved sooner) and has not been disapproved.M.G.L. c. 175, § 172 ↗
- For the adjuster to enforce the contract, it must be signed by a named insured on the policy (or their authorized designee), and the adjuster must give that person a copy.M.G.L. c. 175, § 172 ↗
- The contract must clearly state your 3-day cancellation right and must include the state's required cancellation notice printed in at least 10-point bold type.M.G.L. c. 175, § 172 ↗
- If your policy names a mortgage lender, a lender that claims payment under the policy is treated as a beneficiary of your contract with the public adjuster.M.G.L. c. 175, § 172 ↗
Claim deadlines
- Under the Massachusetts standard fire policy, you must give the insurer immediate written notice of a loss and promptly submit a signed, sworn proof of loss.M.G.L. c. 175, § 99 (standard fire policy) ↗
- Under the standard fire policy, a lawsuit against the insurer must be filed within 2 years of the date of loss, though if the loss amount goes to the policy's reference (appraisal) process, you get at least 90 days after the award.M.G.L. c. 175, § 99 (standard fire policy) ↗
