Terms of Service
These Terms of Service ("Terms") cover your use of bestpublicadjuster.org (the "Site"). The Site is run by Dorothy, Inc. ("Dorothy", "we", "us"). By using the Site or submitting any form on it, you agree to these Terms. If you don't agree, please don't use the Site.
What this site is, and what it isn't
Best Public Adjuster is a free directory of licensed public adjusting firms and a free matching service that connects property owners with those firms.
- We are not a public adjuster. We don't inspect damage, prepare estimates, negotiate with your insurance company or handle your claim.
- We are not an insurance company, a law firm or a lawyer. Nothing on the Site is legal, insurance or financial advice. Our guides are general information, and rules vary by state and by policy.
- A listing is not an endorsement. Firm listings come from official state license records and from each firm's own published information, such as its website. We work to keep listings accurate, but records change and we can't guarantee that every detail is complete or current. Always confirm a firm's license with your state before you sign anything. Our license guide explains how.
Getting matched: your permission to share your information
When you submit our matching form (the "Get matched" or "Request a free call" form), you ask us to connect you with a public adjuster, and you give us permission to do the following.
- Share your request with licensed firms. We may share the information you submit with up to five public adjusting firms that are licensed in the state where your property is. If you asked for a specific firm from its listing, that firm is one of them. Shared information includes your name, phone number, email, property location, claim details, notes, and any document you upload, such as a settlement offer.
- Let those firms contact you. The firms we share your request with may call, text or email you about your claim at the phone number and email you gave us. They may use automated technology to do so. This applies even if your number is on a federal, state or company Do Not Call list.
- Contact you ourselves about your request, for example to confirm details or to let you know which firm will reach out.
Your permission is not a condition of buying anything, and you never have to hire a firm. Message and data rates may apply to texts. You can opt out of texts at any time by replying STOP, and you can ask a firm to stop contacting you at any time. To withdraw your request or opt out of further contact from us, email us at the address below. Opting out stops future sharing and contact from us. It can't undo information we already shared with a firm, but you can ask that firm directly to delete it.
By submitting the form, you confirm that the information is accurate, that the phone number and email are yours, and that you own the property or are authorized to act for its owner or policyholder.
What it costs
Best Public Adjuster is completely free. We don't charge property owners or firms anything. There are no fees for using the directory, getting matched, being listed or receiving requests, and no firm pays us to be matched with you.
If you decide to hire a public adjuster, that firm will usually charge its own fee for handling your claim, often a percentage of your claim payment. That fee is set by your contract with the firm and limited by your state's law. Our fees guide explains how fees work.
Your relationship with a firm
If you hire a firm, your contract is between you and that firm. Dorothy is not a party to it and is not responsible for the firm's advice, work, fees or conduct. Read any contract carefully before you sign, and ask about your right to cancel. Many states give you a short window to cancel a public adjuster contract without penalty.
If you have a problem with a licensed public adjuster, you can contact your state's department of insurance. Please also tell us, so we can review the firm's listing and whether we keep matching people with it.
Documents you upload
You keep ownership of anything you upload. You give us permission to store it and share it with the firms matched to your request, only for the purpose of that request. Please upload only documents about your own claim. We may delete uploads once they are no longer needed for your request.
For public adjusting firms
- Listings. We list licensed firms using official state license records and information the firm publishes. License details always come from official records. A firm can ask us to correct or add details, or to remove optional content, through our claim your listing page. We verify the person asking before we change anything.
- Receiving requests. We share requests only with firms that have agreed to receive them. A firm that receives a request must hold an active license in the property's state, follow all laws that apply to contacting and contracting with property owners (including solicitation, contract, cancellation and fee rules), use the information only to respond to that request, and never sell or pass it to anyone else. We may stop sharing requests with any firm at any time.
- Free for firms. We don't charge firms for listings or for the requests we send them.
Using the site fairly
Please don't submit false information or a request on someone else's behalf without their permission, impersonate a firm, copy or scrape the directory in bulk, interfere with the Site's security or operation, or use the Site for anything unlawful. We may block access or ignore requests that break these rules.
Your privacy
We collect the information you submit in our forms and basic technical data such as your IP address and browser type, which we use to prevent spam and to keep a record of your permission. We use your information to process your request, run and improve the Site, and meet legal obligations. We share it with the firms matched to your request, as described above, and with service providers that help us run the Site, such as our hosting, email and messaging providers, who may use it only to provide those services. We may also share it when the law requires it. We do not sell your personal information. Our Privacy Policy gives the full details, including your choices about your data.
Google ratings and reviews
Firm pages may show ratings and reviews from Google Maps. They load directly from Google when you view the page, and we don't write, edit or store them. By using these features, you agree to the Google Maps/Google Earth Additional Terms of Service ↗ and Google's Privacy Policy ↗, which also apply to that content.
Disclaimers and limits on liability
The Site and its information are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We don't promise any outcome on your claim, and we are not responsible for what any firm does or doesn't do.
To the fullest extent the law allows, Dorothy will not be liable for any indirect, incidental, special or consequential damages, or for lost profits or lost claim payments, arising from your use of the Site or any firm you find through it. Our total liability for any claim about the Site is limited to one hundred US dollars ($100). Some places don't allow these limits, so they may not fully apply to you.
Changes to these terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. The version in effect when you submit a request applies to that request.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
